Terms of Service

This Terms of Service Agreement (the "Agreement") is entered into between Serch ("Bot Owner") and the user ("User") of the Kerchy Discord bot, its website and its web dashboard (together, the "Bot"). By using the Bot, the User agrees to be bound by the terms of this Agreement. If the User does not agree to the terms of this Agreement, they should immediately discontinue use of the Bot.

1. Use of the Bot

The Bot Owner grants the User a non-exclusive, non-transferable, limited license to use the Bot for personal or non-commercial purposes. The User must meet Discord's minimum age requirements and follow Discord's Terms of Service and Community Guidelines while using the Bot.

2. Prohibited Use

The User may not use the Bot in any way that violates applicable laws, rules, or regulations or infringes upon the rights of any third party. The User may not use the Bot for any commercial purposes without the express written consent of the Bot Owner. In particular, the User may not:

• Try to make the AI break its rules (for example with "jailbreak" or prompt-injection messages), or use it to create sexual, hateful, violent or otherwise harmful content.
• Create AI personalities, playlists or other content that is illegal, sexual, hateful, harassing, that impersonates real people, or that infringes someone else's rights.
• Use giveaways to scam people, to collect personal data, or to give away anything illegal or against Discord's rules.
• Abuse the Bot's limits, votes, invitations or features (spam, automation, multiple accounts or exploiting bugs).
• Attempt to access data, servers or accounts that do not belong to them, or disrupt the Bot or its infrastructure.

3. Kerchy+ Subscription

Kerchy+ is an optional paid subscription made through Ko-fi. Each monthly payment activates or extends Kerchy+ for the Discord account it is linked to (the Discord account connected on Ko-fi, or the Discord ID written in the payment message). Payments are processed by Ko-fi and its payment providers and are subject to their terms; the Bot Owner never receives card or bank details.

Kerchy+ currently includes a personal AI quota without voting, up to 15 AI personalities (with a photo uploaded from the dashboard or the image of an imported .kerchy file, kept on Kerchy's server), music features without votes, cloud playlists that can be shared with other users, uploading your own images for card backgrounds and giveaways (a giveaway image link is free for everyone), a "Kerchy+" badge next to your name on welcome cards (it can be turned off in the dashboard) and server features (with the Kerchy+ of whoever turns them on in the dashboard, or on an "awakened" server: each subscriber has 3 awakenings to give server Kerchy+ to the servers they choose, their own or someone else's, from the dashboard, which also brings a faster "revive chat" and extended log memory; no server is awakened on its own, not even the subscriber's; if they turn one off, that server keeps it for a few grace days, during which another subscriber can awaken it so it continues, and the person waits a few days before awakening another one): tickets without “Made with Kerchy” and up to 6 ticket panels, a 30-day jail role memory, alerts from more social networks, a custom Kerchy avatar in that server, the AutoMod invite and external link filters with up to 50 blocked words, and a starboard that watches more than 5 channels (or all of them), shows the pictures and videos of starred messages and uses images uploaded for its design. The benefits, limits and price may change over time. When a subscription ends, the account keeps its data but returns to the free limits: the other server it had awakened enters its grace days, cloud playlists become read-only (they can still be viewed, downloaded, loaded and deleted), people a playlist was shared with become read-only and the owner can only remove them, AI personalities over the free limit are locked until the subscription is renewed or other personalities are deleted, card backgrounds that were already uploaded keep working, and server features go back to the free version (the custom Kerchy avatar is restored, extra ticket panels and paid social networks pause, the jail memory goes back to 14 days, the AutoMod invite and link filters pause and only its first 30 blocked words are used, and the starboard only watches its first 5 channels and stops showing pictures and videos). If a payment was not credited correctly, contact the Bot Owner using the address below.

4. AI Features

Kerchy's AI replies are generated automatically by a third-party service (Google Gemini) and may be inaccurate, inappropriate or unexpected. The Bot Owner is not responsible for the content generated by the AI or for actions taken based on it, including moderation actions that server administrators request from the AI.

Every AI personality, including the ones created by users, follows a shared and private set of rules and blocked topics that users cannot change. Users who create a personality are responsible for its name, image, description and dialogue examples. The Bot Owner may remove or disable personalities, channels or content that break these terms. Deleting a personality disables the AI channels that were using it.

Users can add up to 3 of their own Google Gemini API keys in the dashboard's personal settings. Their messages to the AI are then answered only with those keys and the model they chose, without Kerchy's message and image limits (only the limit they set themselves, and voting is still required where it applies). The same AI rules apply with either key. Each user is responsible for their keys, for using them under Google's terms and for any quota or cost they have with Google; the Bot Owner is not responsible if a key stops working, is blocked or runs out of quota.

5. User Content

Users keep their rights over the content they create with the Bot, such as playlists and AI personalities. By using these features, the User allows the Bot to store, process and display that content as needed to provide the features (for example, showing a shared playlist to the people it was shared with, or showing a personality's name and image in a server). Embeds created with the dashboard's Embed Builder are posted by Kerchy through a webhook named "Kerchy [EMBED]"; the person who sends an embed is responsible for its content, and it must follow these terms like any other message. Owners of a shared playlist decide who can access it and what each person can change, and can revoke access at any time. Giveaways created with /giveaway (or from the dashboard) are run by each server: Kerchy only picks the winners at random among the entries and announces them. The Bot Owner does not provide, deliver or guarantee any prize. Social media alerts repost public content from the accounts each server chooses to follow, and that server is responsible for the accounts it follows.

6. Limitation of Liability & Security

The Bot Owner shall not be liable for any damages arising out of the use or inability to use the Bot, including but not limited to, damages for loss of profits, loss of data, or other intangible losses. Furthermore, while reasonable efforts are made to ensure the Bot operates smoothly, the Bot Owner assumes no responsibility or liability in the event of a hack, unauthorized access, data breach, or any other security incident affecting the Bot or third-party platforms.

Moderation features (such as AutoMod, warns and strikes, night mode and the honeypot) act according to the settings chosen by each server's administrators and may make mistakes. The Bot Owner is not responsible for messages they delete or punishments they apply; each server's administrators are responsible for how they configure them.

7. Modifications to the Bot

The Bot Owner may modify or discontinue the Bot, or any of its features, at any time without notice. The User agrees that the Bot Owner shall not be liable to the User or any third party for any modification, suspension, or discontinuance of the Bot.

8. Intellectual Property

Only the underlying source code of the Bot remains the exclusive property of the Bot Owner. The User agrees not to copy, modify, or distribute the Bot's source code without the express written consent of the Bot Owner. User-generated content and server data do not belong to the Bot Owner. Kerchy's character is a fan work inspired by Koishi Komeiji from Touhou Project, whose characters belong to their respective owners.

9. Indemnification

The User agrees to indemnify and hold harmless the Bot Owner, its affiliates, and their respective directors, officers, employees, and agents from any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of the User's use of the Bot.

10. Termination

This Agreement may be terminated by either party at any time for any reason. The Bot Owner may suspend or block access to the Bot or to some of its features for users or servers that break these terms. Upon termination, the User must immediately cease all use of the Bot.

11. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements or representations, whether written or oral, relating to the Bot.

Privacy Policy

This Privacy Policy governs the collection, use, and sharing of information by Kerchy, a Discord bot developed by Serch, including its web dashboard. By using Kerchy, you agree to the terms of this Privacy Policy.

Discord Data & Privileged Intents

To work, Kerchy relies on Discord's privileged intents, and only for the features that need them. The Message Content intent lets Kerchy read the text of messages: it uses this to reply in the AI channels you set up, to react to its name, to run its commands, to filter spam and links while night mode is on, to catch accounts in the honeypot channel, to notice when someone who is AFK writes again or when an AFK member is pinged, and — only if a server administrator turns the log on — to show what an edited or deleted message said. The Server Members intent lets it notice when members join or leave and change their name or avatar, used for welcome and goodbye cards, newcomer inspection, keeping jailed members in jail if they rejoin, the server-tag role and the log. The Presence intent lets it see online/offline status and current activity, used only to count how many members are active and to show a member's status in /info. Kerchy never reads message content to profile you or to train AI models, and outside AI channels it does not keep messages unless the log is enabled, as detailed below.

Information We Collect

We try to keep only what each feature needs. Depending on the features you and your server use, Kerchy stores:

• Server settings: server IDs and the configuration chosen by its administrators (language, channels, roles, AI channels and personalities, the channel and personality used by "revive chat" and the voice AI, music, log, command rules, server tag perks and the role for people wearing the tag, the honeypot decoy channel and how many accounts it caught, night mode rules, ticket panels, reaction roles and their requirements, the jail role and channels, newcomer inspection, social media alerts, etc.).
• AI conversation memory: in AI channels, the messages that talk to the AI (with the author's Discord ID and username and the server name) and the AI's replies. Each channel keeps only its most recent exchanges (up to 40 messages). Server administrators with AI permission can view, edit or delete this memory from the dashboard, and reset it with /ai.
• Usage counters: how many AI messages, images and songs were used per day or week, per server or per user, to apply limits.
• Server log (only if administrators turn it on): message content for up to 5 days (14 with extended memory) so the log can show what an edited or deleted message said, and an event history for up to 7 days (30 with extended memory). The history can include members' name and avatar changes and the actions of Discord's AutoMod, with the message it blocked.
• Giveaways: the prize, text, image and settings of each giveaway, and the Discord IDs of the people who enter and of the winners. They are deleted 7 days after the giveaway ends (they are kept that long so a new winner can be picked), or right away if its message or channel is deleted.
• Server tag role: if a server gives a role to the people wearing its tag, the Discord IDs of the members Kerchy gave that role to, so it only removes it from them.
• Jail (only if administrators turn it on): when someone is sent to jail with /jail, the IDs of the roles they had, who jailed them, when and the reason, so /unjail can give the roles back. They are deleted when the person is released or after 14 days (30 with server Kerchy+).
• Tickets (only if administrators turn them on): for each ticket, its number, the Discord ID of whoever opened it, when, and whether it is closed, while its channel exists. Transcripts (an .html file with the conversation: names, avatars, messages and attachment links) are only created when the server's team asks for one or deletes a ticket, and they are posted in Discord; Kerchy does not keep a copy.
• Social media alerts (only if administrators turn them on): the public accounts a server follows (their ID, name, link and avatar) and the IDs of the latest posts seen, so only new ones are announced.
• Custom Kerchy in a server (Kerchy+): the picture and banner are sent to Discord; Kerchy keeps who changed the profile and when, the nickname and bio written in the dashboard, and the IDs of the picture and banner, to restore the normal profile when Kerchy+ ends or when it is restored.
• /wander: the IDs of the servers that were reviewed for the /wander list (approved or not) and of the approved servers whose administrators hid them from the dashboard.
• AFK status: if you use /afk, the reason you wrote, since when you are AFK and your previous server nickname (to put it back after removing the «[AFK]» prefix). It is deleted as soon as you write again, use /afk again or leave the server.
• Night mode: while it is active, the Discord IDs of the members it punished, how many times, and a short log of what it did (for the server's admin channel). All of it is deleted when night mode ends.
• AutoMod, warns and strikes: messages are checked when they are sent or edited and are not saved (to detect spam, Kerchy only remembers in memory, for about a minute, when each member's recent messages were sent and their IDs, to delete them if they were spam). For each warn and strike (given with /warn, /strike or by AutoMod), the member's Discord ID, when it was given, the reason and the Discord ID of the moderator who gave it. Warns are deleted when they expire (7 days by default) or when they turn into a strike; strikes are permanent by default, unless the server chooses an expiration or a moderator removes them (with /warnings or from the dashboard). Up to 50 of each are kept per person. What they do is recorded in the server log if it is turned on.
• Starboard (only if administrators turn it on): the IDs of the starred messages and of the posts Kerchy made for them in the starboard channel, the star count and when they were starred (up to 2,000 per server), so it can update or remove those posts. If the server has Kerchy+ and turns it on, the first picture and the first video of a starred message (up to 10 MB each) are only loaded into memory to upload them again to Discord in the post, and are not kept by Kerchy; images uploaded for the starboard's design (a Kerchy+ feature) are kept until they are replaced, while image links are only links.
• Levels (only if administrators turn them on): for each member of that server, their XP, how many messages they sent, when they last earned XP and how much they earned today (for the daily cap). Administrators can delete everyone's XP from the dashboard.
• Server tree (only if administrators turn it on): how many messages each member sent during the current tree generation (it is cleared when the tree is reset), golden leaves and gifts collected, harvest votes, who stabilized it during strong winds and the winners of the last harvests. Message content is not saved.
• Suggestions (only if administrators turn them on): the text of each suggestion, its number, the Discord ID, name and avatar link of its author and the Discord IDs of who voted for or against (the latest 500 per server), plus when each member last suggested and how many times today.
• Counting channel (only if administrators turn it on): the next number, the Discord ID of whoever counted last and the ID of their message, the record, the number of resets and, if a punishment role is used, who has it and until when.
• Birthday (only if you save it): the day and month of your birthday, the year only if you add it (to show your age, if you allow it) and, with Kerchy+, the design of your own birthday card and its uploaded background. It is the same for every server with Kerchy, and only servers that turn birthdays on announce it. You can delete it with /birthday (the delete button) or from the dashboard.
• Card backgrounds: images uploaded from the dashboard as backgrounds for a server's cards (a Kerchy+ feature), cropped to 1024×450 px and kept until they are removed from the dashboard.
• Personal settings: your Discord ID together with your Kerchy+ status and dates, your text-to-speech voice, your dashboard appearance (including whether to show your Kerchy+ badge), your cloud playlists (and who you shared them with, including pending invitations, which expire after 2 days), your AI personalities (name, image link, description, dialogue examples and your display name as their creator; if a Kerchy+ subscriber uploads a photo or imports a .kerchy file, the image is saved on Kerchy's server, cropped and resized to 150×150 px; otherwise the image is always a link) and your voice-call time if your server uses /countvc.
• Your own Gemini keys (only if you add them): up to 3 Google Gemini API keys, saved encrypted (AES-256) on Kerchy's server and never shown again (the dashboard only shows their last 4 characters), together with the model you chose, the limits you set, how many messages and images you used today and the last error a key gave. They are only used for your own messages to the AI and are sent to Google through the same Cloudflare Worker. You can delete them at any time from the dashboard; removing the last one turns the feature off.
• Kerchy+ payments: Ko-fi notifies Kerchy of each payment (name, amount, currency, payment message, transaction ID and, if you connected it, your Discord account). We keep the transaction ID to avoid duplicates and, if a payment could not be matched to a Discord account, its details until it is assigned manually.

Some information is only processed temporarily and is not saved: content shown by commands such as snipe or info (including the card that newcomer inspection posts when someone joins; snipe keeps the last deleted messages of a channel in memory for a few minutes), images sent to the AI, voice audio sent to the voice AI for transcription, text read aloud by text-to-speech, music searches, emojis enlarged with /big, embeds sent with the Embed Builder (they are posted in Discord and Kerchy does not keep a copy), Top.gg vote checks and the server tag shown on your profile (used to apply server tag perks).

When you log in to the dashboard with Discord, we receive your Discord profile (ID, username, display name, avatar and server tag) and the list of your servers. Your login token stays in your browser and is only kept in the bot's memory for the session; it is not written to disk. Playlists you save "in this browser", Embed Builder drafts, your dashboard preferences and your session are stored in your browser's local storage, not on our side.

How We Use Your Information

We use this information only to operate Kerchy and its features: answering in AI channels with the right personality and memory (as well as collecting and reviewing interactions to improve the quality and operation of the AI's responses), applying limits, votes and Kerchy+ benefits, saving and sharing playlists, running giveaways, tickets, reaction roles, the jail and social media alerts, showing AFK notices, giving the server tag role, showing the server log, and preventing abuse. We do not use it for advertising and we do not build profiles about you.

Sharing Your Information

We do not sell your information. To provide some features, data is sent to these third-party services, which process it under their own policies:

• Google Gemini (through a Cloudflare Worker that only forwards the request): AI messages, the recent memory of the channel, images and voice audio sent to the AI (with your own Gemini key, if you added one, instead of Kerchy's).
• Serper (Google search): search terms when the AI needs to look something up on the internet.
• Google Translate TTS and Flowery TTS: text read aloud with /vctts.
• Music services: the Lavalink music server and SoundCloud (searches and songs), LRCLIB (lyrics) and iTunes (cover art for uploaded files).
• Ko-fi: Kerchy+ payments. Top.gg: vote checks. jsDelivr (Twemoji): the emoji requested with /big, to download its image.
• MyMemory: the text of the message translated with /traducir. Safebooru: the tags searched with /safebooru.
• Social networks: to check the accounts a server follows, Kerchy asks YouTube, Twitch, Kick, Bluesky, Reddit, SoundCloud, Mastodon or the RSS feed chosen by the server for their public posts; it only sends the account being checked.

Shared playlists are visible to the people the owner shares them with, and the name, image and creator of an AI personality are visible in the servers where it is used (uploaded photos and images imported from .kerchy files are served from a public link so Discord can show them). Giveaway winners are announced publicly, with a mention, in the giveaway's channel. We may also disclose information in response to legal process or a request from a law enforcement agency or regulatory authority.

Data Retention

AI memory, log data, giveaways, the jail role memory, ticket records (when the ticket's channel is deleted), AFK statuses, night mode records and pending invitations are deleted automatically as described above. Social media accounts that no server follows anymore are forgotten at the next check. The memory of a channel that stops being an AI channel is discarded at the next daily reset. Playlists, AI personalities (including their saved images) and card backgrounds are kept until you delete them from the dashboard or with /playlist. Kerchy+ records are kept as a history of your subscription. Server settings are kept while they are needed to run the Bot in that server. To recover from server failures, Kerchy keeps automatic backup copies of its data files (not the log memory or uploaded images) for up to 3 days.

Your Choices

You can delete your playlists and AI personalities at any time from the dashboard, leave playlists shared with you, leave a giveaway by pressing its button again and stop being AFK by writing a message or using /afk again. Server administrators can clear the AI memory, turn the log and any other feature off, release jailed members and remove uploaded card backgrounds. To request a copy or the deletion of other data linked to your Discord account or server, contact us at the address below.

Data Security

We take reasonable measures to protect the data we hold, such as saving it in a way that survives power cuts and keeping short-lived backups. However, as stated in our Terms of Service, no system is perfectly secure. We cannot guarantee absolute security and are not legally responsible for unauthorized breaches or malicious exploits outside of our control.

Changes to this Policy

We may update this Privacy Policy from time to time. Your continued use of Kerchy after we make changes to this policy indicates your acceptance of the revised policy.

Este Acuerdo de Términos de Servicio (el «Acuerdo») se celebra entre Serch («Dueño del Bot») y el usuario («Usuario») del bot de Discord Kerchy, su sitio web y su dashboard web (en conjunto, el «Bot»). 1. Uso del Bot

El Dueño del Bot otorga al Usuario una licencia limitada, no exclusiva e intransferible para usar el Bot con fines personales o no comerciales. El Usuario debe cumplir la edad mínima que exige Discord y seguir los Términos de Servicio de Discord y sus Normas de la Comunidad mientras usa el Bot.

2. Uso prohibido

El Usuario no puede usar el Bot de ninguna forma que infrinja leyes, normas o regulaciones aplicables, ni que vulnere los derechos de terceros. Tampoco puede usarlo con fines comerciales sin el consentimiento expreso y por escrito del Dueño del Bot. En particular, el Usuario no puede:

• Intentar que la IA rompa sus reglas (por ejemplo, con mensajes de «jailbreak» o de inyección de instrucciones), ni usarla para crear contenido sexual, de odio, violento o dañino de cualquier otro tipo.
• Crear personalidades de IA, playlists u otro contenido ilegal, sexual, de odio o de acoso, que se haga pasar por personas reales o que infrinja los derechos de otras personas.
• Usar los sorteos para estafar, para recopilar datos personales o para regalar algo ilegal o contrario a las normas de Discord.
• Abusar de los límites, votos, invitaciones o funciones del Bot (spam, automatización, varias cuentas o aprovechar errores).
• Intentar acceder a datos, servidores o cuentas que no le pertenecen, o interferir con el Bot o su infraestructura.

3. Suscripción Kerchy+

Kerchy+ es una suscripción de pago opcional que se realiza a través de Ko-fi. Cada pago mensual activa o extiende Kerchy+ para la cuenta de Discord a la que está vinculado (la cuenta de Discord conectada en Ko-fi, o el ID de Discord escrito en el mensaje del pago). Los pagos los procesan Ko-fi y sus proveedores de pago y están sujetos a sus términos; el Dueño del Bot nunca recibe datos de tarjetas ni bancarios.

Kerchy+ incluye actualmente un cupo personal de IA sin votar, hasta 15 personalidades de IA (con una foto subida desde el dashboard o la imagen de un archivo .kerchy importado, guardadas en el servidor de Kerchy), funciones de música sin votos, playlists en la nube que se pueden compartir con otros usuarios, subir imágenes propias como fondo de los carteles y para los sorteos (un link de imagen en un sorteo es gratis para todos), una insignia «Kerchy+» junto a tu nombre en los carteles de bienvenida (se puede desactivar en el dashboard) y funciones de servidor (con el Kerchy+ de quien las activa en el dashboard o en un servidor «despierto»: cada suscriptor tiene 3 despertares para darle Kerchy+ de servidor a los servidores que elija, propios o ajenos, desde el dashboard, lo que también da un «revivir chat» más frecuente y la memoria extendida del registro; ningún servidor se despierta solo, ni siquiera los del suscriptor; si apaga uno, ese servidor lo conserva unos días de gracia, durante los cuales otro suscriptor puede despertarlo para que siga, y la persona espera unos días antes de despertar otro): tickets sin «Creado usando Kerchy» y hasta 6 paneles de tickets, memoria de roles de la cárcel de 30 días, avisos de más redes sociales, un avatar propio de Kerchy en ese servidor, los filtros de invitaciones y enlaces externos del AutoMod con hasta 50 palabras bloqueadas, y un starboard que vigila más de 5 canales (o todos), muestra las fotos y videos de los mensajes destacados y usa imágenes subidas para su diseño. Los beneficios, límites y precio pueden cambiar con el tiempo. Cuando una suscripción termina, la cuenta conserva sus datos pero vuelve a los límites gratuitos: el servidor ajeno que tenía despierto entra en sus días de gracia, las playlists en la nube quedan en solo lectura (se pueden ver, descargar, cargar y borrar), las personas con las que se compartió una playlist pasan a solo lectura y el dueño solo puede quitarlas, las personalidades de IA por encima del límite gratuito quedan bloqueadas hasta renovar la suscripción o borrar otras, los fondos de carteles ya subidos siguen funcionando, y las funciones de servidor vuelven a la versión gratis (el avatar propio de Kerchy se restaura, los paneles de tickets extra y las redes sociales de pago quedan en pausa, la memoria de la cárcel vuelve a 14 días, los filtros de invitaciones y enlaces del AutoMod se pausan y solo se usan sus primeras 30 palabras bloqueadas, y el starboard solo vigila sus primeros 5 canales y deja de mostrar fotos y videos). Si un pago no se acreditó correctamente, contacta al Dueño del Bot en la dirección de abajo.

4. Funciones de IA

Las respuestas de la IA de Kerchy las genera automáticamente un servicio externo (Google Gemini) y pueden ser inexactas, inapropiadas o inesperadas. El Dueño del Bot no es responsable del contenido generado por la IA ni de las acciones tomadas a partir de él, incluidas las acciones de moderación que los administradores de un servidor le pidan a la IA.

Toda personalidad de IA, incluidas las que crean los usuarios, sigue un conjunto de reglas y temas bloqueados, compartido y privado, que los usuarios no pueden cambiar. Quien crea una personalidad es responsable de su nombre, imagen, descripción y ejemplos de diálogo. El Dueño del Bot puede quitar o desactivar personalidades, canales o contenido que incumplan estos términos. Borrar una personalidad desactiva los canales de IA que la usaban.

Los usuarios pueden añadir hasta 3 claves propias de la API de Google Gemini en la configuración personal del dashboard. Entonces sus mensajes a la IA se responden solo con esas claves y el modelo que eligieron, sin los límites de mensajes e imágenes de Kerchy (solo el límite que ellos mismos pongan, y votar sigue siendo necesario donde corresponda). Las mismas reglas de la IA se aplican con cualquier clave. Cada usuario es responsable de sus claves, de usarlas según los términos de Google y de cualquier cuota o costo que tenga con Google; el Dueño del Bot no es responsable si una clave deja de funcionar, se bloquea o se queda sin cuota.

5. Contenido del Usuario

Los usuarios conservan sus derechos sobre el contenido que crean con el Bot, como playlists y personalidades de IA. Al usar estas funciones, el Usuario permite que el Bot guarde, procese y muestre ese contenido en la medida necesaria para ofrecer las funciones (por ejemplo, mostrar una playlist compartida a las personas con las que se compartió, o mostrar el nombre y la imagen de una personalidad en un servidor). Los embeds creados con el Embed Builder del dashboard los publica Kerchy mediante un webhook llamado «Kerchy [EMBED]»; quien envía un embed es responsable de su contenido, que debe cumplir estos términos como cualquier otro mensaje. Los dueños de una playlist compartida deciden quién puede acceder a ella y qué puede cambiar cada persona, y pueden revocar el acceso en cualquier momento. Los sorteos creados con /giveaway (o desde el dashboard) los organiza cada servidor: Kerchy solo elige a los ganadores al azar entre los participantes y los anuncia. El Dueño del Bot no ofrece, entrega ni garantiza ningún premio. Los avisos de redes sociales publican contenido público de las cuentas que cada servidor elige seguir, y ese servidor es responsable de las cuentas que sigue.

6. Limitación de responsabilidad y seguridad

El Dueño del Bot no será responsable de ningún daño derivado del uso o de la imposibilidad de usar el Bot, incluidos, entre otros, los daños por pérdida de beneficios, pérdida de datos u otras pérdidas intangibles. Además, aunque se hacen esfuerzos razonables para que el Bot funcione correctamente, el Dueño del Bot no asume ninguna responsabilidad en caso de hackeo, acceso no autorizado, filtración de datos o cualquier otro incidente de seguridad que afecte al Bot o a plataformas de terceros.

Las funciones de moderación (como el AutoMod, los warns y strikes, el modo nocturno y el honeypot) actúan según la configuración que eligen los administradores de cada servidor y pueden equivocarse. El Dueño del Bot no es responsable de los mensajes que borren ni de los castigos que apliquen; los administradores de cada servidor son responsables de cómo las configuran.

7. Modificaciones del Bot

El Dueño del Bot puede modificar o discontinuar el Bot, o cualquiera de sus funciones, en cualquier momento y sin previo aviso. El Usuario acepta que el Dueño del Bot no será responsable ante el Usuario ni ante terceros por ninguna modificación, suspensión o interrupción del Bot.

8. Propiedad intelectual

Solo el código fuente del Bot es propiedad exclusiva del Dueño del Bot. El Usuario acepta no copiar, modificar ni distribuir el código fuente del Bot sin el consentimiento expreso y por escrito del Dueño del Bot. El contenido generado por los usuarios y los datos de los servidores no pertenecen al Dueño del Bot. El personaje de Kerchy es una obra de fans inspirada en Koishi Komeiji de Touhou Project, cuyos personajes pertenecen a sus respectivos dueños.

9. Indemnización

El Usuario acepta indemnizar y mantener indemne al Dueño del Bot, a sus afiliados y a sus respectivos directores, responsables, empleados y agentes frente a toda reclamación, daño, responsabilidad, costo y gasto, incluidos honorarios razonables de abogados, que surjan del uso del Bot por parte del Usuario.

10. Terminación

Cualquiera de las partes puede terminar este Acuerdo en cualquier momento y por cualquier motivo. El Dueño del Bot puede suspender o bloquear el acceso al Bot, o a algunas de sus funciones, a usuarios o servidores que incumplan estos términos. Al terminar el Acuerdo, el Usuario debe dejar de usar el Bot de inmediato.

11. Acuerdo completo

Este Acuerdo constituye el acuerdo completo entre las partes y reemplaza cualquier acuerdo o declaración anterior o contemporánea, escrita u oral, relacionada con el Bot.

Política de Privacidad

Esta Política de Privacidad regula la recopilación, el uso y el intercambio de información por parte de Kerchy, un bot de Discord desarrollado por Serch, incluido su dashboard web. Al usar Kerchy, aceptas los términos de esta Política de Privacidad.

Datos de Discord e Intents Privilegiados

Para funcionar, Kerchy usa los intents privilegiados de Discord, y solo para las funciones que los necesitan. El intent de Contenido de Mensajes permite que Kerchy lea el texto de los mensajes: lo usa para responder en los canales de IA que configures, para reaccionar a su nombre, para ejecutar sus comandos, para filtrar spam y links mientras el modo nocturno está activo, para atrapar cuentas en el canal señuelo del honeypot, para notar cuando alguien que está AFK vuelve a escribir o cuando mencionan a alguien que está AFK y —solo si un administrador activa el registro— para mostrar qué decía un mensaje editado o borrado. El intent de Miembros del Servidor le permite ver cuándo entran o salen miembros y cuándo cambian su nombre o avatar, lo que se usa para los carteles de bienvenida y despedida, la inspección de nuevos, mantener en la cárcel a quien sale y vuelve a entrar, el rol de la etiqueta del servidor y el registro. El intent de Presencia le permite ver el estado en línea o desconectado y la actividad actual, usado solo para contar cuántos miembros están activos y para mostrar el estado de un miembro en /info. Kerchy nunca lee el contenido de los mensajes para perfilarte ni para entrenar modelos de IA, y fuera de los canales de IA no guarda los mensajes salvo que el registro esté activado, como se detalla más abajo.

Información que recopilamos

Intentamos guardar solo lo que cada función necesita. Según las funciones que uses tú y tu servidor, Kerchy guarda:

• Configuración del servidor: los IDs de los servidores y la configuración elegida por sus administradores (idioma, canales, roles, canales y personalidades de IA, el canal y la personalidad que usan «revivir chat» y la IA de voz, música, registro, reglas de comandos, beneficios de la etiqueta del servidor y el rol para quienes la llevan, el canal señuelo del honeypot y cuántas cuentas atrapó, las reglas del modo nocturno, los paneles de tickets, los roles por reacción y sus requisitos, el rol y los canales de la cárcel, la inspección de nuevos, los avisos de redes sociales, etc.).
• Memoria de conversación de la IA: en los canales de IA, los mensajes que le hablan a la IA (con el ID y el nombre de usuario de Discord del autor y el nombre del servidor) y las respuestas de la IA. Cada canal guarda solo sus intercambios más recientes (hasta 40 mensajes). Los administradores del servidor con permiso de IA pueden ver, editar o borrar esta memoria desde el dashboard, y reiniciarla con /ia.
• Contadores de uso: cuántos mensajes de IA, imágenes y canciones se usaron por día o por semana, por servidor o por usuario, para aplicar los límites.
• Registro del servidor (solo si los administradores lo activan): el contenido de los mensajes durante hasta 5 días (14 con la memoria extendida), para que el registro pueda mostrar qué decía un mensaje editado o borrado, y un historial de eventos de hasta 7 días (30 con la memoria extendida). El historial puede incluir los cambios de nombre y avatar de los miembros y las acciones del AutoMod de Discord, con el mensaje que bloqueó.
• Sorteos: el premio, el texto, la imagen y la configuración de cada sorteo, y los IDs de Discord de quienes participan y de quienes ganan. Se borran 7 días después de que el sorteo termina (se guardan ese tiempo para poder elegir otro ganador), o al momento si se borra su mensaje o su canal.
• Rol de la etiqueta del servidor: si un servidor da un rol a quienes llevan su etiqueta, los IDs de Discord de los miembros a quienes Kerchy les dio ese rol, para quitárselo solo a ellos.
• Cárcel (solo si los administradores la activan): cuando alguien es enviado a la cárcel con /jail, los IDs de los roles que tenía, quién lo encarceló, cuándo y el motivo, para que /unjail le devuelva los roles. Se borran cuando se libera a esa persona o a los 14 días (30 con Kerchy+ del servidor).
• Tickets (solo si los administradores los activan): de cada ticket, su número, el ID de Discord de quien lo abrió, cuándo y si está cerrado, mientras exista su canal. Las transcripciones (un archivo .html con la conversación: nombres, avatares, mensajes y links de los adjuntos) solo se crean cuando el equipo del servidor pide una o borra un ticket, y se publican en Discord; Kerchy no guarda una copia.
• Avisos de redes sociales (solo si los administradores los activan): las cuentas públicas que sigue un servidor (su ID, nombre, link y avatar) y los IDs de las últimas publicaciones vistas, para avisar solo de las nuevas.
• Custom Kerchy en un servidor (Kerchy+): la foto y el banner se mandan a Discord; Kerchy guarda quién cambió el perfil y cuándo, el apodo y la descripción escritos en el dashboard, y los identificadores de la foto y el banner, para volver al perfil normal cuando termine Kerchy+ o cuando lo restauren.
• /deambular: las IDs de los servidores que se revisaron para la lista de /deambular (aprobados o no) y de los aprobados que sus administradores ocultaron desde el dashboard.
• Estado AFK: si usas /afk, el motivo que escribiste, desde cuándo estás AFK y tu apodo anterior en el servidor (para devolvértelo al quitar el «[AFK]»). Se borra en cuanto vuelves a escribir, usas /afk otra vez o sales del servidor.
• Modo nocturno: mientras está activo, los IDs de Discord de los miembros que castigó, cuántas veces y un registro corto de lo que hizo (para el canal de admins del servidor). Todo se borra cuando termina el modo nocturno.
• AutoMod, warns y strikes: los mensajes se revisan cuando se envían o se editan y no se guardan (para detectar spam, Kerchy solo recuerda en memoria, durante un minuto aproximadamente, cuándo se enviaron los últimos mensajes de cada miembro y sus IDs, para borrarlos si eran spam). Por cada warn y strike (dados con /warn, /strike o por el AutoMod), el ID de Discord del miembro, cuándo se le dio, el motivo y el ID de Discord del moderador que lo dio. Los warns se borran cuando caducan (a los 7 días por defecto) o cuando se convierten en un strike; los strikes son permanentes por defecto, salvo que el servidor elija que caduquen o que un moderador los quite (con /warnings o desde el dashboard). Se guardan hasta 50 de cada uno por persona. Lo que hacen queda en el registro del servidor si está activado.
• Starboard (solo si los administradores lo activan): los IDs de los mensajes destacados y de las publicaciones que Kerchy hizo para ellos en el canal del starboard, el número de estrellas y cuándo se destacaron (hasta 2000 por servidor), para poder actualizar o quitar esas publicaciones. Si el servidor tiene Kerchy+ y lo activa, la primera imagen y el primer video de un mensaje destacado (hasta 10 MB cada uno) solo se cargan en la memoria para volver a subirlos a Discord en la publicación, y Kerchy no los guarda; las imágenes subidas para el diseño del starboard (una función de Kerchy+) se guardan hasta que se reemplazan, y los links de imágenes son solo links.
• Niveles (solo si los administradores los activan): de cada miembro de ese servidor, su XP, cuántos mensajes mandó, cuándo ganó XP por última vez y cuánta ganó hoy (para el tope diario). Los administradores pueden borrar la XP de todos desde el dashboard.
• Árbol del servidor (solo si los administradores lo activan): cuántos mensajes mandó cada miembro durante la generación actual del árbol (se borra cuando el árbol se reinicia), las hojas doradas y regalos que juntó, los votos de la cosecha, quién lo estabilizó en los vientos fuertes y los ganadores de las últimas cosechas. El contenido de los mensajes no se guarda.
• Sugerencias (solo si los administradores las activan): el texto de cada sugerencia, su número, el ID de Discord, el nombre y el link de la foto de quien la mandó y los IDs de Discord de quienes votaron a favor o en contra (las últimas 500 por servidor), además de cuándo sugirió cada miembro por última vez y cuántas veces hoy.
• Canal para contar (solo si los administradores lo activan): el número que sigue, el ID de Discord de quien contó último y el de su mensaje, el récord, la cantidad de reinicios y, si se usa un rol de castigo, quién lo tiene y hasta cuándo.
• Cumpleaños (solo si lo guardas): el día y el mes de tu cumpleaños, el año solo si lo agregas (para mostrar tu edad, si lo permites) y, con Kerchy+, el diseño de tu propio cartel de cumpleaños y su fondo subido. Es el mismo para todos los servidores con Kerchy y solo lo anuncian los servidores que activan los cumpleaños. Puedes borrarlo con /birthday (botón «Borrar») o desde el dashboard.
• Fondos de los carteles: las imágenes subidas desde el dashboard como fondo de los carteles de un servidor (función de Kerchy+), recortadas a 1024×450 px y guardadas hasta que se quitan desde el dashboard.
• Configuración personal: tu ID de Discord junto con tu estado y fechas de Kerchy+, tu voz de texto a voz, la apariencia de tu dashboard (incluido si se muestra tu insignia Kerchy+), tus playlists en la nube (y con quién las compartiste, incluidas las invitaciones pendientes, que caducan a los 2 días), tus personalidades de IA (nombre, link de la imagen, descripción, ejemplos de diálogo y tu nombre visible como su creador; si un suscriptor de Kerchy+ sube una foto o importa un archivo .kerchy, la imagen se guarda en el servidor de Kerchy, recortada y redimensionada a 150×150 px; si no, la imagen siempre es un link) y tu tiempo en llamadas de voz si tu servidor usa /countvc.
• Tus claves propias de Gemini (solo si las añades): hasta 3 claves de la API de Google Gemini, guardadas cifradas (AES-256) en el servidor de Kerchy y que nunca se vuelven a mostrar (el dashboard solo muestra sus últimos 4 caracteres), junto con el modelo que elegiste, los límites que pusiste, cuántos mensajes e imágenes usaste hoy y el último error que dio una clave. Solo se usan para tus propios mensajes a la IA y se envían a Google por el mismo Cloudflare Worker. Puedes borrarlas cuando quieras desde el dashboard; al quitar la última, la función se apaga.
• Pagos de Kerchy+: Ko-fi avisa a Kerchy de cada pago (nombre, monto, moneda, mensaje del pago, ID de transacción y, si la conectaste, tu cuenta de Discord). Guardamos el ID de transacción para evitar duplicados y, si un pago no se pudo asociar a una cuenta de Discord, sus datos hasta que se asigna a mano.

Alguna información solo se procesa de forma temporal y no se guarda: el contenido que muestran comandos como snipe o info (también la ficha que manda la inspección de nuevos cuando alguien entra; snipe guarda en memoria los últimos mensajes borrados de un canal durante unos minutos), las imágenes enviadas a la IA, el audio de voz enviado a la IA de voz para transcribirlo, el texto leído en voz alta por el texto a voz, las búsquedas de música, los emojis agrandados con /big, los embeds enviados con el Embed Builder (se publican en Discord y Kerchy no guarda una copia), las comprobaciones de votos de Top.gg y la etiqueta del servidor que se muestra en tu perfil (se usa para aplicar los beneficios de la etiqueta).

Cuando inicias sesión en el dashboard con Discord, recibimos tu perfil de Discord (ID, nombre de usuario, nombre visible, avatar y etiqueta del servidor) y la lista de tus servidores. Tu token de inicio de sesión se queda en tu navegador y solo se guarda en la memoria del bot durante la sesión; no se escribe en disco. Las playlists que guardas «en este navegador», los borradores del Embed Builder, tus preferencias del dashboard y tu sesión se guardan en el almacenamiento local de tu navegador, no de nuestro lado.

Cómo usamos tu información

Usamos esta información solo para que Kerchy y sus funciones funcionen: responder en los canales de IA con la personalidad y la memoria correctas (así como recopilar y revisar los mensajes para mejorar el funcionamiento de las respuestas de la IA), aplicar límites, votos y beneficios de Kerchy+, guardar y compartir playlists, hacer sorteos, tickets, roles por reacción, la cárcel y los avisos de redes sociales, mostrar los avisos de AFK, dar el rol de la etiqueta del servidor, mostrar el registro del servidor y evitar abusos. No la usamos para publicidad y no creamos perfiles sobre ti.

Con quién compartimos tu información

No vendemos tu información. Para ofrecer algunas funciones, se envían datos a estos servicios externos, que los procesan según sus propias políticas:

• Google Gemini (a través de un Cloudflare Worker que solo reenvía la petición): los mensajes de IA, la memoria reciente del canal, las imágenes y el audio de voz enviados a la IA (con tu propia clave de Gemini, si añadiste una, en lugar de la de Kerchy).
• Serper (búsqueda de Google): los términos de búsqueda cuando la IA necesita buscar algo en internet.
• Google Translate TTS y Flowery TTS: el texto leído en voz alta con /vctts.
• Servicios de música: el servidor de música Lavalink y SoundCloud (búsquedas y canciones), LRCLIB (letras) e iTunes (portadas de los archivos subidos).
• Ko-fi: los pagos de Kerchy+. Top.gg: las comprobaciones de votos. jsDelivr (Twemoji): el emoji pedido con /big, para descargar su imagen.
• MyMemory: el texto del mensaje que se traduce con /traducir. Safebooru: los tags que se buscan con /safebooru.
• Redes sociales: para revisar las cuentas que sigue un servidor, Kerchy les pide sus publicaciones públicas a YouTube, Twitch, Kick, Bluesky, Reddit, SoundCloud, Mastodon o al feed RSS elegido por el servidor; solo se envía la cuenta que se revisa.

Las playlists compartidas son visibles para las personas con las que el dueño las comparte, y el nombre, la imagen y el creador de una personalidad de IA son visibles en los servidores donde se usa (las fotos subidas y las imágenes importadas de archivos .kerchy se sirven desde un link público para que Discord pueda mostrarlas). Los ganadores de un sorteo se anuncian públicamente, con una mención, en el canal del sorteo. También podemos revelar información en respuesta a un proceso legal o a una solicitud de una autoridad policial o regulatoria.

Conservación de los datos

La memoria de la IA, los datos del registro, los sorteos, la memoria de roles de la cárcel, los datos de los tickets (cuando se borra su canal), los estados AFK, los datos del modo nocturno y las invitaciones pendientes se borran automáticamente como se describe arriba. Las cuentas de redes sociales que ya no sigue ningún servidor se olvidan en la siguiente revisión. La memoria de un canal que deja de ser de IA se descarta en el siguiente reinicio diario. Las playlists, las personalidades de IA (incluidas sus imágenes guardadas) y los fondos de los carteles se conservan hasta que los borras desde el dashboard o con /playlist. Los registros de Kerchy+ se conservan como historial de tu suscripción. La configuración de un servidor se conserva mientras sea necesaria para que el Bot funcione en ese servidor. Para recuperarse de fallas del servidor, Kerchy guarda copias de seguridad automáticas de sus archivos de datos (no de la memoria del registro ni de las imágenes subidas) durante un máximo de 3 días.

Tus opciones

Puedes borrar tus playlists y personalidades de IA en cualquier momento desde el dashboard, salir de las playlists compartidas contigo, salir de un sorteo pulsando otra vez su botón y dejar de estar AFK escribiendo un mensaje o usando /afk otra vez. Los administradores del servidor pueden borrar la memoria de la IA, apagar el registro y cualquier otra función, liberar a quienes están en la cárcel y quitar los fondos subidos de los carteles. Para pedir una copia o el borrado de otros datos vinculados a tu cuenta de Discord o a tu servidor, escríbenos a la dirección de abajo.

Seguridad de los datos

Tomamos medidas razonables para proteger los datos que guardamos, como guardarlos de forma que sobrevivan a los cortes de energía y conservar copias de seguridad de corta duración. Sin embargo, como se indica en nuestros Términos de Servicio, ningún sistema es perfectamente seguro. No podemos garantizar una seguridad absoluta y no somos legalmente responsables de filtraciones no autorizadas ni de ataques fuera de nuestro control.

Cambios en esta política

Podemos actualizar esta Política de Privacidad de vez en cuando. Si sigues usando Kerchy después de que hagamos cambios, aceptas la política revisada.

この利用規約 (以下「本規約」) は、Serch (以下「Bot運営者」) と、DiscordのBot「Kerchy」、そのWebサイトおよびWebダッシュボード (以下総称して「本Bot」) の利用者 (以下「ユーザー」) との間で締結されるものです。ユーザーは本Botを利用することで、本規約に同意したものとみなされます。本規約に同意しない場合は、直ちに本Botの利用を中止してください。

1. 本Botの利用

Bot運営者は、ユーザーに対し、個人的または非商用の目的で本Botを利用するための、非独占的かつ譲渡不能な限定的ライセンスを付与します。ユーザーはDiscordの最低年齢要件を満たし、本Botの利用中はDiscord利用規約およびコミュニティガイドラインに従う必要があります。

2. 禁止事項

ユーザーは、適用される法律・規則・規制に違反する方法や、第三者の権利を侵害する方法で本Botを利用してはなりません。また、Bot運営者の書面による明示的な同意なく、本Botを商用目的で利用してはなりません。特に、ユーザーは次の行為をしてはなりません。

• AIにルールを破らせようとすること (「ジェイルブレイク」やプロンプトインジェクションのメッセージなど)、またはAIを使って性的・差別的・暴力的、その他有害なコンテンツを作成すること。
• 違法、性的、差別的、または嫌がらせとなるもの、実在の人物になりすますもの、他者の権利を侵害するものであるAIパーソナリティ、プレイリストその他のコンテンツを作成すること。
• 抽選を詐欺や個人情報の収集に使うこと、または違法なものやDiscordのルールに反するものを景品にすること。
• 本Botの制限、投票、招待または機能を悪用すること (スパム、自動化、複数アカウント、不具合の悪用など)。
• 自分のものではないデータ、サーバー、アカウントにアクセスしようとすること、または本Botやそのインフラを妨害すること。

3. Kerchy+ サブスクリプション

Kerchy+は、Ko-fiを通じて行う任意の有料サブスクリプションです。毎月の支払いごとに、紐づけられたDiscordアカウント (Ko-fiで連携したDiscordアカウント、または支払いメッセージに書かれたDiscord ID) のKerchy+が有効化または延長されます。支払いはKo-fiとその決済事業者が処理し、それぞれの規約に従います。Bot運営者がカードや銀行の情報を受け取ることはありません。

Kerchy+には現在、投票なしで使える個人用のAI利用枠、最大15個のAIパーソナリティ (ダッシュボードからアップロードした写真や、インポートした.kerchyファイルの画像をKerchyのサーバーに保存する機能を含む)、投票なしの音楽機能、他のユーザーと共有できるクラウドプレイリスト、カードの背景や抽選に自分の画像をアップロードする機能 (抽選の画像リンクは誰でも無料)、ウェルカムカードで名前の横に表示される「Kerchy+」バッジ (ダッシュボードでオフにできます)、そしてサーバー機能 (ダッシュボードで有効にした人のKerchy+、または「目覚めた」サーバー: 加入者は3回分の目覚めを持ち、ダッシュボードから選んだサーバー (自分のサーバーでも他の人のサーバーでも) にサーバーのKerchy+を付けられます。より頻繁な「チャット復活」や記録の拡張メモリーも使えるようになります。加入者自身のサーバーも含め、自動で目覚めるサーバーはありません。オフにすると、そのサーバーは数日の猶予期間だけ機能を保ち、その間は別の加入者が目覚めさせて続けることができます。オフにした人は別のサーバーを目覚めさせるまで数日待ちます): 「Kerchyで作成」なしのチケットと最大6個のチケットパネル、牢屋のロールの30日間保存、より多くのSNSの通知、そのサーバーだけのKerchyのアイコン、AutoModの招待リンク・外部リンクのフィルターと最大50個のブロックワード、5つを超えるチャンネル (またはすべてのチャンネル) を見張り、スターが付いたメッセージの画像と動画を表示し、デザイン用の画像をアップロードできるスターボードが含まれます。特典、制限、価格は変更されることがあります。サブスクリプションが終了してもアカウントのデータは残りますが、無料の制限に戻ります。目覚めさせていた他のサーバーは猶予期間に入ります。クラウドプレイリストは読み取り専用になり (表示・ダウンロード・読み込み・削除は可能)、プレイリストを共有された人も読み取り専用になってオーナーは削除のみ行えます。無料の上限を超えるAIパーソナリティは、サブスクリプションを更新するか他のパーソナリティを削除するまでロックされます。すでにアップロードしたカードの背景は引き続き使えます。サーバー機能は無料版に戻ります (Kerchyの独自アイコンは元に戻り、追加のチケットパネルと有料のSNSは一時停止し、牢屋の保存期間は14日間に戻り、AutoModの招待リンク・外部リンクのフィルターは一時停止して最初の30個のブロックワードだけが使われ、スターボードは最初の5つのチャンネルだけを見張り、画像と動画を表示しなくなります)。支払いが正しく反映されなかった場合は、下記の連絡先までBot運営者にご連絡ください。

4. AI機能

KerchyのAIの返答は外部サービス (Google Gemini) によって自動的に生成され、不正確、不適切または予期しない内容になることがあります。Bot運営者は、AIが生成した内容や、それに基づいて行われた行為 (サーバー管理者がAIに依頼したモデレーション操作を含みます) について責任を負いません。

ユーザーが作成したものを含むすべてのAIパーソナリティは、ユーザーが変更できない共通の非公開ルールとブロック対象の話題に従います。パーソナリティを作成したユーザーは、その名前、画像、説明、会話の例に責任を負います。Bot運営者は、本規約に違反するパーソナリティ、チャンネル、コンテンツを削除または無効化することがあります。パーソナリティを削除すると、それを使っていたAIチャンネルは無効になります。

ユーザーはダッシュボードの個人設定で、自分のGoogle Gemini APIキーを最大3つ追加できます。その場合、そのユーザーのAIへのメッセージは、そのキーと選んだモデルだけで返答され、Kerchyのメッセージと画像の制限はかかりません (自分で設定した制限だけがかかり、必要な場合は引き続き投票が必要です)。どちらのキーでも同じAIのルールが適用されます。各ユーザーは、自分のキー、Googleの規約に沿ったその利用、Googleとの間の利用枠や費用に責任を負います。キーが使えなくなった、ブロックされた、または利用枠を使い切った場合について、Bot運営者は責任を負いません。

5. ユーザーコンテンツ

ユーザーは、プレイリストやAIパーソナリティなど、本Botで作成したコンテンツに対する権利を保持します。これらの機能を利用することで、ユーザーは、機能の提供に必要な範囲でそのコンテンツを本Botが保存・処理・表示すること (共有されたプレイリストを共有相手に表示する、パーソナリティの名前と画像をサーバーで表示するなど) を許可します。ダッシュボードのEmbed Builderで作成した埋め込みは、Kerchyが「Kerchy [EMBED]」という名前のウェブフックで投稿します。埋め込みの内容には送信した人が責任を負い、他のメッセージと同様に本規約に従う必要があります。共有プレイリストのオーナーは、誰がアクセスできるか、各自が何を変更できるかを決め、いつでもアクセス権を取り消せます。/giveaway (またはダッシュボード) で作成した抽選は各サーバーが主催するものです。Kerchyは参加者の中から当選者を無作為に選んで発表するだけで、Bot運営者が景品を提供・配送・保証することはありません。SNS通知は、各サーバーがフォローすると決めたアカウントの公開コンテンツを投稿するもので、フォローするアカウントについてはそのサーバーが責任を負います。

6. 責任の制限とセキュリティ

Bot運営者は、本Botの利用または利用できないことによって生じたいかなる損害 (利益の損失、データの損失その他の無形の損失を含みますが、これらに限りません) についても責任を負いません。また、本Botが円滑に動作するよう合理的な努力をしていますが、本Botまたは第三者のプラットフォームに影響するハッキング、不正アクセス、データ漏洩その他のセキュリティ事故について、Bot運営者は一切の責任を負いません。

モデレーション機能 (AutoMod、警告とストライク、ナイトモード、ハニーポットなど) は、各サーバーの管理者が選んだ設定に従って動作し、誤ることがあります。これらが削除したメッセージや与えた処罰について、Bot運営者は責任を負いません。その設定については各サーバーの管理者が責任を負います。

7. 本Botの変更

Bot運営者は、予告なくいつでも本Botまたはその機能を変更または終了することができます。ユーザーは、本Botの変更、停止または終了について、Bot運営者がユーザーまたは第三者に対して責任を負わないことに同意します。

8. 知的財産

本BotのソースコードのみがBot運営者の独占的な財産です。ユーザーは、Bot運営者の書面による明示的な同意なく、本Botのソースコードを複製、改変または配布しないことに同意します。ユーザーが作成したコンテンツとサーバーのデータはBot運営者のものではありません。Kerchyのキャラクターは東方Projectの古明地こいしに着想を得た二次創作であり、東方Projectのキャラクターの権利は各権利者に帰属します。

9. 補償

ユーザーは、ユーザーによる本Botの利用から生じるあらゆる請求、損害、責任、費用および経費 (合理的な弁護士費用を含みます) について、Bot運営者、その関係者、ならびにそれぞれの取締役、役員、従業員および代理人を補償し、免責することに同意します。

10. 契約の終了

いずれの当事者も、いつでも理由を問わず本規約を終了できます。Bot運営者は、本規約に違反するユーザーまたはサーバーに対し、本Botまたはその一部の機能へのアクセスを停止またはブロックすることがあります。本規約が終了した場合、ユーザーは直ちに本Botの利用をすべて中止しなければなりません。

11. 完全合意

本規約は、本Botに関する当事者間の完全な合意を構成し、書面か口頭かを問わず、それ以前または同時期のすべての合意や表明に優先します。

プライバシーポリシー

本プライバシーポリシーは、Serchが開発したDiscordのBot「Kerchy」(Webダッシュボードを含みます) による情報の収集、利用および共有について定めるものです。Kerchyを利用することで、あなたは本プライバシーポリシーに同意したものとみなされます。

Discordのデータと特権インテント

Kerchyは動作のために、必要な機能に限ってDiscordの特権インテントを使用します。メッセージコンテンツインテントはメッセージの本文を読み取るためのもので、設定したAIチャンネルで返信する、名前に反応する、コマンドを実行する、ナイトモード中にスパムやリンクを取り締まる、ハニーポットのチャンネルでアカウントを捕まえる、AFKの人が書き込んだことやAFKの人がメンションされたことに気づく、そして（サーバー管理者が記録を有効にした場合のみ）編集・削除されたメッセージの内容を表示する、といった用途に使います。サーバーメンバーインテントは、メンバーの参加・退出や名前・アバターの変更を把握するためのもので、ようこそ／お別れカード、新規メンバーの確認、牢屋から抜けて再参加した人を牢屋に戻す処理、サーバータグのロール、記録に使います。プレゼンスインテントはオンライン／オフラインの状態と現在のアクティビティを把握するためのもので、アクティブなメンバー数を数えることと、/info でメンバーの状態を表示することだけに使います。Kerchyは、あなたをプロファイリングしたりAIモデルを学習させたりするためにメッセージの内容を読むことは一切なく、AIチャンネル以外では、以下に記載のとおり記録が有効な場合を除いてメッセージを保存しません。

収集する情報

各機能に必要なものだけを保存するよう努めています。あなたとあなたのサーバーが使う機能に応じて、Kerchyは次の情報を保存します。

• サーバー設定: サーバーIDと、管理者が選んだ設定 (言語、チャンネル、ロール、AIチャンネルとパーソナリティ、「チャット復活」と音声AIが使うチャンネルとパーソナリティ、音楽、記録、コマンドのルール、サーバータグの特典とタグを付けている人に付与するロール、ハニーポットのおとりチャンネルと捕まえたアカウント数、ナイトモードのルール、チケットのパネル、リアクションロールとその条件、牢屋のロールとチャンネル、新規メンバーの確認、SNS通知など)。
• AIの会話メモリー: AIチャンネルで、AIに話しかけたメッセージ (投稿者のDiscord IDとユーザー名、サーバー名とともに) とAIの返答。各チャンネルは直近のやり取り (最大40件) だけを保持します。AI権限を持つサーバー管理者は、ダッシュボードからこのメモリーを表示・編集・削除でき、/ai でリセットできます。
• 利用回数: 制限を適用するため、サーバーごとまたはユーザーごとに、1日または1週間に使われたAIメッセージ、画像、曲の数。
• サーバーの記録 (管理者が有効にした場合のみ): 編集・削除されたメッセージの内容を表示するために最大5日間 (拡張メモリーでは14日間) 保存するメッセージの内容と、最大7日間 (拡張メモリーでは30日間) のイベント履歴。履歴には、メンバーの名前やアバターの変更、DiscordのAutoModの対応 (ブロックしたメッセージを含みます) が含まれることがあります。
• 抽選: 各抽選の景品、テキスト、画像、設定と、参加者および当選者のDiscord ID。抽選終了の7日後に削除されます (再抽選できるようにその間保存します)。抽選のメッセージやチャンネルが削除された場合は、すぐに削除されます。
• サーバータグのロール: サーバーがタグを付けている人にロールを付与している場合、Kerchyがそのロールを付与したメンバーのDiscord ID (その人たちからだけロールを外すため)。
• 牢屋 (管理者が有効にした場合のみ): /jail で牢屋に入れられた人が持っていたロールのID、実行者、日時、理由。/unjail でロールを戻すために使います。釈放されたとき、または14日後 (サーバーのKerchy+があれば30日後) に削除されます。
• チケット (管理者が有効にした場合のみ): チャンネルが存在する間、各チケットの番号、作成者のDiscord ID、日時、閉じているかどうか。トランスクリプト (名前・アイコン・メッセージ・添付ファイルのリンクを含む会話の .html ファイル) は、サーバーのスタッフが求めたときかチケットを削除したときだけ作成され、Discordに投稿されます。Kerchyはコピーを保存しません。
• SNS通知 (管理者が有効にした場合のみ): サーバーがフォローする公開アカウント (ID・名前・リンク・アイコン) と、最近見た投稿のID。新しい投稿だけを通知するために使います。
• サーバーでのCustom Kerchy (Kerchy+): アイコンとバナーはDiscordに送られます。Kerchy+が終わったときや元に戻すときのために、誰がいつプロフィールを変えたか、ダッシュボードで書いたニックネームと自己紹介、アイコンとバナーのIDを保存します。
• /deambular: /deambular の一覧のために審査したサーバー (承認・非承認) と、承認済みで管理者がダッシュボードから非表示にしたサーバーのID。
• AFKの状態: /afk を使った場合、書いた理由、AFKになった日時、そのサーバーでの元のニックネーム (「[AFK]」を外すときに戻すため)。書き込むか、もう一度 /afk を使うか、サーバーを抜けた時点で削除されます。
• ナイトモード: 有効中、処罰したメンバーのDiscord ID、その回数、行ったことの短い記録 (サーバーの管理者チャンネル用)。ナイトモードが終わるとすべて削除されます。
• AutoMod、警告、ストライク: メッセージは送信・編集されたときに確認され、保存されません (スパムを検出するため、各メンバーの最近のメッセージの送信時刻とID (スパムだった場合に削除するため) だけを約1分間メモリーに覚えます)。警告とストライク (/warn、/strike、AutoModによるもの) ごとに、メンバーのDiscord ID、与えられた日時、理由、与えたモデレーターのDiscord ID。警告は期限が切れたとき (初期設定は7日) かストライクに変わったときに削除されます。ストライクは初期設定では永久で、サーバーが期限を選んだ場合や、モデレーターが (/warnings またはダッシュボードから) 消した場合に削除されます。1人につきそれぞれ最大50件まで保存します。行ったことは、サーバーの記録が有効なら記録されます。
• スターボード (管理者が有効にした場合のみ): スターが付いたメッセージと、それについてKerchyがスターボードのチャンネルに投稿したもののID、スターの数と付いた日時 (サーバーごとに最大2,000件)。投稿を更新または削除するために使います。サーバーにKerchy+があり有効にした場合、スターが付いたメッセージの最初の画像と動画 (それぞれ10MBまで) は、投稿の中でDiscordに再アップロードするためにメモリー上にだけ読み込まれ、Kerchyは保存しません。スターボードのデザイン用にアップロードした画像 (Kerchy+の機能) は置き換えるまで保存され、画像のリンクはリンクのままです。
• カードの背景: サーバーのカードの背景としてダッシュボードからアップロードされた画像 (Kerchy+の機能)。1024×450 pxに切り抜かれ、ダッシュボードで削除されるまで保存されます。
• 個人設定: あなたのDiscord IDとKerchy+の状態・日付、読み上げの声、ダッシュボードの見た目 (Kerchy+バッジを表示するかどうかを含みます)、クラウドプレイリスト (共有した相手と、2日で期限切れになる保留中の招待を含みます)、AIパーソナリティ (名前、画像のリンク、説明、会話の例、作成者としてのあなたの表示名。Kerchy+の加入者が写真をアップロードするか.kerchyファイルをインポートした場合、その画像は150×150 pxに切り抜き・縮小してKerchyのサーバーに保存されます。それ以外の場合、画像は常にリンクです)、そしてサーバーが /countvc を使っている場合はボイス通話の時間。
• 自分のGeminiキー (追加した場合のみ): 最大3つのGoogle Gemini APIキー。暗号化 (AES-256) してKerchyのサーバーに保存され、二度と表示されません (ダッシュボードには最後の4文字だけが表示されます)。選んだモデル、設定した制限、今日使ったメッセージと画像の数、キーが最後に出したエラーも保存します。あなた自身のAIへのメッセージにだけ使われ、同じCloudflare Workerを通してGoogleに送られます。ダッシュボードからいつでも削除でき、最後のキーを削除するとこの機能はオフになります。
• Kerchy+の支払い: Ko-fiは各支払い (名前、金額、通貨、支払いメッセージ、取引ID、連携している場合はDiscordアカウント) をKerchyに通知します。重複を防ぐために取引IDを保存し、Discordアカウントと紐づけられなかった支払いは、手動で割り当てるまでその内容を保存します。

一部の情報は一時的に処理されるだけで保存されません: snipe や info などのコマンドで表示する内容 (新規メンバーの確認で参加時に送るカードも含みます。snipeはチャンネルで最後に削除されたメッセージを数分間メモリーに保持します)、AIに送られた画像、文字起こしのために音声AIに送られた音声、読み上げで読まれたテキスト、音楽の検索、/big で拡大した絵文字、Embed Builderで送った埋め込み (Discordに投稿され、Kerchyはコピーを保存しません)、Top.ggの投票確認、そしてあなたのプロフィールに表示されるサーバータグ (タグの特典を適用するために使用) です。

Discordでダッシュボードにログインすると、あなたのDiscordプロフィール (ID、ユーザー名、表示名、アバター、サーバータグ) とサーバーの一覧を受け取ります。ログイントークンはあなたのブラウザに保存され、Botのメモリーにはセッション中だけ保持されます。ディスクには書き込まれません。「このブラウザに」保存したプレイリスト、Embed Builderの下書き、ダッシュボードの設定、セッションは、こちら側ではなく、あなたのブラウザのローカルストレージに保存されます。

情報の利用方法

これらの情報は、Kerchyとその機能を動かすためだけに使います: 正しいパーソナリティとメモリーでAIチャンネルに返答する（およびAIの返答の動作や品質を改善するためにメッセージを収集・確認する）、制限・投票・Kerchy+の特典を適用する、プレイリストを保存・共有する、抽選・チケット・リアクションロール・牢屋・SNS通知を動かす、AFKのお知らせを表示する、サーバータグのロールを付与する、サーバーの記録を表示する、不正利用を防ぐ。広告には使わず、あなたのプロフィールを作成することもありません。

情報の共有

あなたの情報を販売することはありません。一部の機能を提供するため、次の外部サービスにデータが送られ、それぞれのポリシーに従って処理されます。

• Google Gemini (リクエストを転送するだけのCloudflare Workerを経由): AIへのメッセージ、チャンネルの最近のメモリー、AIに送られた画像と音声 (自分のGeminiキーを追加した場合は、Kerchyのキーの代わりにそのキーを使います)。
• Serper (Google検索): AIがインターネットで調べる必要があるときの検索語。
• Google翻訳TTSとFlowery TTS: /vctts で読み上げるテキスト。
• 音楽サービス: 音楽サーバーLavalinkとSoundCloud (検索と曲)、LRCLIB (歌詞)、iTunes (アップロードされたファイルのジャケット画像)。
• Ko-fi: Kerchy+の支払い。Top.gg: 投票の確認。jsDelivr (Twemoji): /big で指定された絵文字の画像のダウンロード。
• MyMemory: /traducir で翻訳するメッセージの本文。Safebooru: /safebooru で検索するタグ。
• SNS: サーバーがフォローするアカウントを確認するため、YouTube・Twitch・Kick・Bluesky・Reddit・SoundCloud・Mastodon、またはサーバーが選んだRSSフィードに公開投稿を問い合わせます。送るのは確認するアカウントだけです。

共有プレイリストはオーナーが共有した相手に表示され、AIパーソナリティの名前・画像・作成者は、それが使われているサーバーで表示されます (アップロードした写真と.kerchyファイルからインポートした画像は、Discordが表示できるよう公開リンクで配信されます)。抽選の当選者は、抽選のチャンネルでメンション付きで公開発表されます。また、法的手続きや警察・規制当局からの要請に応じて情報を開示することがあります。

データの保持

AIのメモリー、記録のデータ、抽選、牢屋のロールの保存、チケットの記録 (チャンネルが削除されたとき)、AFKの状態、ナイトモードの記録、保留中の招待は、上記のとおり自動的に削除されます。どのサーバーもフォローしなくなったSNSのアカウントは、次の確認で消去されます。AIチャンネルでなくなったチャンネルのメモリーは、次の日次リセットで破棄されます。プレイリスト、AIパーソナリティ (保存された画像を含みます)、カードの背景は、ダッシュボードまたは /playlist で削除するまで保存されます。Kerchy+の記録は、サブスクリプションの履歴として保存されます。サーバー設定は、そのサーバーで本Botを動かすために必要な間保存されます。サーバー障害から復旧するため、Kerchyはデータファイルの自動バックアップ (記録のメモリーとアップロードされた画像を除きます) を最大3日間保存します。

あなたの選択

プレイリストとAIパーソナリティはダッシュボードからいつでも削除でき、共有されたプレイリストから抜けたり、抽選のボタンをもう一度押して抽選から抜けたり、メッセージを書くかもう一度 /afk を使ってAFKを解除したりできます。サーバー管理者は、AIのメモリーを消去し、記録やその他の機能をオフにし、牢屋の人を釈放し、アップロードしたカードの背景を削除できます。あなたのDiscordアカウントやサーバーに紐づくその他のデータのコピーや削除を希望する場合は、下記の連絡先までご連絡ください。

データの安全性

停電でも失われない方法でデータを保存し、短期間のバックアップを保持するなど、保有するデータを守るために合理的な対策を講じています。ただし、利用規約に記載のとおり、完全に安全なシステムはありません。絶対的な安全を保証することはできず、当方の管理外で起きた不正な侵害や悪意ある攻撃について法的責任を負いません。

本ポリシーの変更

本プライバシーポリシーは随時更新されることがあります。変更後もKerchyを利用し続けた場合、改訂後のポリシーに同意したものとみなされます。
